Toxic Waters:Clean Water Laws Are Neglected, at a Cost to Health

Jennifer Hall-Massey knows not to drink the tap water in her home near Charleston, W.Va.

In fact, her entire family tries to avoid any contact with the water. Her youngest son has scabs on his arms, legs and chest where the bathwater — polluted with lead, nickel and other heavy metals — caused painful rashes. Many of his brother’s teeth were capped to replace enamel that was eaten away.

Neighbors apply special lotions after showering because their skin burns. Tests show that their tap water contains arsenic, barium, lead, manganese and other chemicals at concentrations federal regulators say could contribute to cancer and damage the kidneys and nervous system.

“How can we get digital cable and Internet in our homes, but not clean water?” said Mrs. Hall-Massey, a senior accountant at one of the state’s largest banks.

She and her husband, Charles, do not live in some remote corner of Appalachia. Charleston, the state capital, is less than 17 miles from her home.

“How is this still happening today?” she asked.

When Mrs. Hall-Massey and 264 neighbors sued nine nearby coal companies, accusing them of putting dangerous waste into local water supplies, their lawyer did not have to look far for evidence. As required by state law, some of the companies had disclosed in reports to regulators that they were pumping into the ground illegal concentrations of chemicals — the same pollutants that flowed from residents’ taps.

But state regulators never fined or punished those companies for breaking those pollution laws.

This pattern is not limited to West Virginia. Almost four decades ago, Congress passed the Clean Water Act to force polluters to disclose the toxins they dump into waterways and to give regulators the power to fine or jail offenders. States have passed pollution statutes of their own. But in recent years, violations of the Clean Water Act have risen steadily across the nation, an extensive review of water pollution records by The New York Times found.

In the last five years alone, chemical factories, manufacturing plants and other workplaces have violated water pollution laws more than half a million times. The violations range from failing to report emissions to dumping toxins at concentrations regulators say might contribute to cancer, birth defects and other illnesses.

However, the vast majority of those polluters have escaped punishment. State officials have repeatedly ignored obvious illegal dumping, and the Environmental Protection Agency, which can prosecute polluters when states fail to act, has often declined to intervene.

Because it is difficult to determine what causes diseases like cancer, it is impossible to know how many illnesses are the result of water pollution, or contaminants’ role in the health problems of specific individuals.

But concerns over these toxins are great enough that Congress and the E.P.A. regulate more than 100 pollutants through the Clean Water Act and strictly limit 91 chemicals or contaminants in tap water through the Safe Drinking Water Act.

Regulators themselves acknowledge lapses. The new E.P.A. administrator, Lisa P. Jackson, said in an interview that despite many successes since the Clean Water Act was passed in 1972, today the nation’s water does not meet public health goals, and enforcement of water pollution laws is unacceptably low. She added that strengthening water protections is among her top priorities. State regulators say they are doing their best with insufficient resources.

The Times obtained hundreds of thousands of water pollution records through Freedom of Information Act requests to every state and the E.P.A., and compiled a national database of water pollution violations that is more comprehensive than those maintained by states or the E.P.A. In addition, The Times interviewed more than 250 state and federal regulators, water-system managers, environmental advocates and scientists.

That research shows that an estimated one in 10 Americans have been exposed to drinking water that contains dangerous chemicals or fails to meet a federal health benchmark in other ways.

Those exposures include carcinogens in the tap water of major American cities and unsafe chemicals in drinking-water wells. Wells, which are not typically regulated by the Safe Drinking Water Act, are more likely to contain contaminants than municipal water systems.

Because most of today’s water pollution has no scent or taste, many people who consume dangerous chemicals do not realize it, even after they become sick, researchers say.

But an estimated 19.5 million Americans fall ill each year from drinking water contaminated with parasites, bacteria or viruses, according to a study published last year in the scientific journal Reviews of Environmental Contamination and Toxicology. That figure does not include illnesses caused by other chemicals and toxins.

In the nation’s largest dairy states, like Wisconsin and California, farmers have sprayed liquefied animal feces onto fields, where it has seeped into wells, causing severe infections. Tap water in parts of the Farm Belt, including cities in Illinois, Kansas, Missouri and Indiana, has contained pesticides at concentrations that some scientists have linked to birth defects and fertility problems.

In parts of New York, Rhode Island, Ohio, California and other states where sewer systems cannot accommodate heavy rains, untreated human waste has flowed into rivers and washed onto beaches. Drinking water in parts of New Jersey, New York, Arizona and Massachusetts shows some of the highest concentrations of tetrachloroethylene, a dry cleaning solvent that has been linked to kidney damage and cancer. The Times’s research also shows that last year, 40 percent of the nation’s community water systems violated the Safe Drinking Water Act at least once, according to an analysis of E.P.A. data. Those violations ranged from failing to maintain proper paperwork to allowing carcinogens into tap water. More than 23 million people received drinking water from municipal systems that violated a health-based standard.

In some cases, people got sick right away. In other situations, pollutants like chemicals, inorganic toxins and heavy metals can accumulate in the body for years or decades before they cause problems. Some of the most frequently detected contaminants have been linked to cancer, birth defects and neurological disorders.

Records analyzed by The Times indicate that the Clean Water Act has been violated more than 506,000 times since 2004, by more than 23,000 companies and other facilities, according to reports submitted by polluters themselves. Companies sometimes test what they are dumping only once a quarter, so the actual number of days when they broke the law is often far higher. And some companies illegally avoid reporting their emissions, say officials, so infractions go unrecorded.

Environmental groups say the number of Clean Water Act violations has increased significantly in the last decade. Comprehensive data go back only five years but show that the number of facilities violating the Clean Water Act grew more than 16 percent from 2004 to 2007, the most recent year with complete data.

Polluters include small companies, like gas stations, dry cleaners, shopping malls and the Friendly Acres Mobile Home Park in Laporte, Ind., which acknowledged to regulators that it had dumped human waste into a nearby river for three years.

They also include large operations, like chemical factories, power plants, sewage treatment centers and one of the biggest zinc smelters, the Horsehead Corporation of Pennsylvania, which has dumped illegal concentrations of copper, lead, zinc, chlorine and selenium into the Ohio River. Those chemicals can contribute to mental retardation and cancer.

Some violations are relatively minor. But about 60 percent of the polluters were deemed in “significant noncompliance” — meaning their violations were the most serious kind, like dumping cancer-causing chemicals or failing to measure or report when they pollute.

Finally, the Times’s research shows that fewer than 3 percent of Clean Water Act violations resulted in fines or other significant punishments by state officials. And the E.P.A. has often declined to prosecute polluters or force states to strengthen their enforcement by threatening to withhold federal money or take away powers the agency has delegated to state officials.

Neither Friendly Acres Mobile Home Park nor Horsehead, for instance, was fined for Clean Water Act violations in the last eight years. A representative of Friendly Acres declined to comment. Indiana officials say they are investigating the mobile home park. A representative of Horsehead said the company had taken steps to control pollution and was negotiating with regulators to clean up its emissions.

Numerous state and federal lawmakers said they were unaware that pollution was so widespread.

“I don’t think anyone realized how bad things have become,” said Representative James L. Oberstar, a Minnesota Democrat, when told of The Times’s findings. Mr. Oberstar is chairman of the House Transportation and Infrastructure Committee, which has jurisdiction over many water-quality issues.

“The E.P.A. and states have completely dropped the ball,” he said. “Without oversight and enforcement, companies will use our lakes and rivers as dumping grounds — and that’s exactly what is apparently going on.”

The E.P.A. administrator, Ms. Jackson, whose appointment was confirmed in January, said in an interview that she intended to strengthen enforcement of the Clean Water Act and pressure states to apply the law.

“I’ve been saying since Day One I want to work on these water issues pretty broadly across the country,” she said. On Friday, the E.P.A. said that it was reviewing dozens of coal-mining permits in West Virginia and three other states to make sure they would not violate the Clean Water Act.

After E.P.A. officials received detailed questions from The New York Times in June, Ms. Jackson sent a memo to her enforcement deputy noting that the E.P.A. is “falling short of this administration’s expectations for the effectiveness of our clean water enforcement programs. Data available to E.P.A. shows that, in many parts of the country, the level of significant noncompliance with permitting requirements is unacceptably high and the level of enforcement activity is unacceptably low.”

State officials, for their part, attribute rising pollution rates to increased workloads and dwindling resources. In 46 states, local regulators have primary responsibility for crucial aspects of the Clean Water Act. Though the number of regulated facilities has more than doubled in the last 10 years, many state enforcement budgets have remained essentially flat when adjusted for inflation. In New York, for example, the number of regulated polluters has almost doubled to 19,000 in the last decade, but the number of inspections each year has remained about the same.

But stretched resources are only part of the reason polluters escape punishment. The Times’s investigation shows that in West Virginia and other states, powerful industries have often successfully lobbied to undermine effective regulation.

State officials also argue that water pollution statistics include minor infractions, like failing to file reports, which do not pose risks to human health, and that records collected by The Times failed to examine informal enforcement methods, like sending warning letters.

“We work enormously hard inspecting our coal mines, analyzing water samples, notifying companies of violations when we detect them,” said Randy Huffman, head of West Virginia’s Department of Environmental Protection. “When I look at how far we’ve come in protecting the state’s waters since we took responsibility for the Clean Water Act, I think we have a lot to be proud of.”

But unchecked pollution remains a problem in many states. West Virginia offers a revealing example of why so many companies escape punishment.

One Community’s Plight

The mountains surrounding the home of Mrs. Hall-Massey’s family and West Virginia’s nearby capital have long been mined for coal. And for years, the area enjoyed clean well water.

But starting about a decade ago, awful smells began coming from local taps. The water was sometimes gray, cloudy and oily. Bathtubs and washers developed rust-colored rings that scrubbing could not remove. When Mrs. Hall-Massey’s husband installed industrial water filters, they quickly turned black. Tests showed that their water contained toxic amounts of lead, manganese, barium and other metals that can contribute to organ failure or developmental problems.

Around that time, nearby coal companies had begun pumping industrial waste into the ground.

Mining companies often wash their coal to remove impurities. The leftover liquid — a black fluid containing dissolved minerals and chemicals, known as sludge or slurry — is often disposed of in vast lagoons or through injection into abandoned mines. The liquid in those lagoons and shafts can flow through cracks in the earth into water supplies. Companies must regularly send samples of the injected liquid to labs, which provide reports that are forwarded to state regulators.

In the eight miles surrounding Mrs. Hall-Massey’s home, coal companies have injected more than 1.9 billion gallons of coal slurry and sludge into the ground since 2004, according to a review of thousands of state records. Millions more gallons have been dumped into lagoons.

These underground injections have contained chemicals at concentrations that pose serious health risks, and thousands of injections have violated state regulations and the Safe Drinking Water Act, according to reports sent to the state by companies themselves.

For instance, three coal companies — Loadout, Remington Coal and Pine Ridge, a subsidiary of Peabody Energy, one of the largest coal companies in the world — reported to state officials that 93 percent of the waste they injected near this community had illegal concentrations of chemicals including arsenic, lead, chromium, beryllium or nickel.

Sometimes those concentrations exceeded legal limits by as much as 1,000 percent. Those chemicals have been shown to contribute to cancer, organ failures and other diseases.

But those companies were never fined or punished for those illegal injections, according to state records. They were never even warned that their activities had been noticed.

Remington Coal declined to comment. A representative of Loadout’s parent said the company had assigned its permit to another company, which ceased injecting in 2006. Peabody Energy, which spun off Pine Ridge in 2007, said that some data sent to regulators was inaccurate and that the company’s actions reflected best industry practices.

West Virginia officials, when asked about these violations, said regulators had accidentally overlooked many pollution records the companies submitted until after the statute of limitations had passed, so no action was taken. They also said their studies indicated that those injections could not have affected drinking water in the area and that other injections also had no detectable effect.

State officials noted that they had cited more than 4,200 water pollution violations at mine sites around the state since 2000, as well as conducted thousands of investigations. The state has initiated research about how mining affects water quality. After receiving questions from The Times, officials announced a statewide moratorium on issuing injection permits and told some companies that regulators were investigating their injections.

“Many of the issues you are examining are several years old, and many have been addressed,” West Virginia officials wrote in a statement. The state’s pollution program “has had its share of issues,” regulators wrote. However, “it is important to note that if the close scrutiny given to our state had been given to others, it is likely that similar issues would have been found.”

More than 350 other companies and facilities in West Virginia have also violated the Clean Water Act in recent years, records show. Those infractions include releasing illegal concentrations of iron, manganese, aluminum and other chemicals into lakes and rivers.

As the water in Mrs. Hall-Massey’s community continued to worsen, residents began complaining of increased health problems. Gall bladder diseases, fertility problems, miscarriages and kidney and thyroid issues became common, according to interviews.

When Mrs. Hall-Massey’s family left on vacation, her sons’ rashes cleared up. When they returned, the rashes reappeared. Her dentist told her that chemicals appeared to be damaging her teeth and her son’s, she said. As the quality of her water worsened, Mrs. Hall-Massey’s once-healthy teeth needed many crowns. Her son brushed his teeth often, used a fluoride rinse twice a day and was not allowed to eat sweets. Even so, he continued getting cavities until the family stopped using tap water. By the time his younger brother’s teeth started coming in, the family was using bottled water to brush. He has not had dental problems.

Medical professionals in the area say residents show unusually high rates of health problems. A survey of more than 100 residents conducted by a nurse hired by Mrs. Hall-Massey’s lawyer indicated that as many as 30 percent of people in this area have had their gallbladders removed, and as many as half the residents have significant tooth enamel damage, chronic stomach problems and other illnesses. That research was confirmed through interviews with residents.

It is difficult to determine which companies, if any, are responsible for the contamination that made its way into tap water or to conclude which specific chemicals, if any, are responsible for particular health problems. Many coal companies say they did not pollute the area’s drinking water and chose injection sites that flowed away from nearby homes.

An independent study by a university researcher challenges some of those claims.

“I don’t know what else could be polluting these wells,” said Ben Stout, a biology professor at Wheeling Jesuit University who tested the water in this community and elsewhere in West Virginia. “The chemicals coming out of people’s taps are identical to the chemicals the coal companies are pumping into the ground.”

One night, Mrs. Hall-Massey’s 6-year-old son, Clay, asked to play in the tub. When he got out, his bright red rashes hurt so much he could not fall asleep. Soon, Mrs. Hall-Massey began complaining to state officials. They told her they did not know why her water was bad, she recalls, but doubted coal companies had done anything wrong. The family put their house on the market, but because of the water, buyers were not interested.

In December, Mrs. Hall-Massey and neighbors sued in county court, seeking compensation. That suit is pending. To resolve a related lawsuit filed about the same time, the community today gets regular deliveries of clean drinking water, stored in coolers or large blue barrels outside most homes. Construction began in August on a pipeline bringing fresh water to the community.

But for now most residents still use polluted water to bathe, shower and wash dishes.

“A parent’s only real job is to protect our children,” Mrs. Hall-Massey said. “But where was the government when we needed them to protect us from this stuff?”

Regulators ‘Overwhelmed’

Matthew Crum, a 43-year-old lawyer, wanted to protect people like Mrs. Hall-Massey. That is why he joined West Virginia’s environmental protection agency in 2001, when it became clear that the state’s and nation’s streams and rivers were becoming more polluted.

But he said he quickly learned that good intentions could not compete with intimidating politicians and a fearful bureaucracy.

Mr. Crum grew up during a golden age of environmental activism. He was in elementary school when Congress passed the Clean Water Act of 1972 in response to environmental disasters, including a fire on the polluted Cuyahoga River in Cleveland. The act’s goal was to eliminate most water pollution by 1985 and prohibit the “discharge of toxic pollutants in toxic amounts.”

“There were a bunch of us that were raised with the example of the Clean Water Act as inspiration,” he said. “I wanted to be part of that fight.”

In the two decades after the act’s passage, the nation’s waters grew much healthier. The Cuyahoga River, West Virginia’s Kanawha River and hundreds of other beaches, streams and ponds were revitalized.

But in the late 1990s, some states’ enforcement of pollution laws began tapering off, according to regulators and environmentalists. Soon the E.P.A. started reporting that the nation’s rivers, lakes and estuaries were becoming dirtier again. Mr. Crum, after a stint in Washington with the Justice Department and the birth of his first child, joined West Virginia’s Department of Environmental Protection, where new leadership was committed to revitalizing the Clean Water Act.

He said his idealism was tested within two weeks, when he was called to a huge coal spill into a stream.

“I met our inspector at the spill site, and we had this really awkward conversation,” Mr. Crum recalled. “I said we should shut down the mine until everything was cleaned up. The inspector agreed, but he said if he issued that order, he was scared of getting demoted or transferred to the middle of nowhere. Everyone was terrified of doing their job.”

Mr. Crum temporarily shut the mine.

In the next two years, he shut many polluting mines until they changed their ways. His tough approach raised his profile around the state.

Mining companies, worried about attracting Mr. Crum’s attention, began improving their waste disposal practices, executives from that period said. But they also began complaining to their friends in the state’s legislature, they recalled in interviews, and started a whisper campaign accusing Mr. Crum of vendettas against particular companies — though those same executives now admit they had no evidence for those claims.

In 2003, a new director, Stephanie Timmermeyer, was nominated to run the Department of Environmental Protection. One of West Virginia’s most powerful state lawmakers, Eustace Frederick, said she would be confirmed, but only if she agreed to fire Mr. Crum, according to several people who said they witnessed the conversation.

She was given the job and soon summoned Mr. Crum to her office. He was dismissed two weeks after his second child’s birth.

Ms. Timmermeyer, who resigned in 2008, did not return calls. Mr. Frederick died last year.

Since then, hundreds of workplaces in West Virginia have violated pollution laws without paying fines. A half-dozen current and former employees, in interviews, said their enforcement efforts had been undermined by bureaucratic disorganization, a departmental preference to let polluters escape punishment if they promise to try harder, and a revolving door of regulators who leave for higher-paying jobs at the companies they once policed.

“We are outmanned and overwhelmed, and that’s exactly how industry wants us,” said one employee who requested anonymity for fear of being fired. “It’s been obvious for decades that we’re not on top of things, and coal companies have earned billions relying on that.”

In June, four environmental groups petitioned the E.P.A. to take over much of West Virginia’s handling of the Clean Water Act, citing a “nearly complete breakdown” in the state. The E.P.A. has asked state officials to respond and said it is investigating the petition.

Similar problems exist in other states, where critics say regulators have often turned a blind eye to polluters. Regulators in five other states, in interviews, said they had been pressured by industry-friendly politicians to drop continuing pollution investigations.

“Unless the E.P.A. is pushing state regulators, a culture of transgression and apathy sets in,” said William K. Reilly, who led the E.P.A. under President George H. W. Bush.

In response, many state officials defend their efforts. A spokeswoman for West Virginia’s Department of Environmental Protection, for instance, said that between 2006 and 2008, the number of cease-operation orders issued by regulators was 10 percent higher than during Mr. Crum’s two-year tenure.

Mr. Huffman, the department’s head, said there is no political interference with current investigations. Department officials say they continue to improve the agency’s procedures, and note that regulators have assessed $14.7 million in state fines against more than 70 mining companies since 2006.

However, that is about equal to the revenue those businesses’ parent companies collect every 10 hours, according to financial reports. (To find out about every state’s enforcement record and read comments from regulators, visit www.nytimes.com/waterdata.)

“The real test is, is our water clean?” said Mr. Huffman. “When the Clean Water Act was passed, this river that flows through our capital was very dirty. Thirty years later, it’s much cleaner because we’ve chosen priorities carefully.”

Some regulators admit that polluters have fallen through the cracks. To genuinely improve enforcement, they say, the E.P.A. needs to lead.

“If you don’t have vigorous oversight by the feds, then everything just goes limp,” said Mr. Crum. “Regulators can’t afford to have some backbone unless they know Washington or the governor’s office will back them up.”

It took Mr. Crum a while to recover from his firing. He moved to Virginia to work at the Nature Conservancy, an environmental conservation group. Today, he is in private practice and works on the occasional environmental lawsuit.

“We’re moving backwards,” he said, “and it’s heartbreaking.”

Shortcomings of the E.P.A.

The memos are marked “DO NOT DISTRIBUTE.”

They were written this year by E.P.A. staff, the culmination of a five-year investigation of states’ enforcement of federal pollution laws. And in bland, bureaucratic terms, they describe a regulatory system — at the E.P.A. and among state agencies — that in many ways simply does not work.

For years, according to one memo, federal regulators knew that more than 30 states had major problems documenting which companies were violating pollution laws. Another notes that states’ “personnel lack direction, ability or training” to levy fines large enough to deter polluters.

But often, the memos say, the E.P.A. never corrected those problems even though they were widely acknowledged. The E.P.A. “may hesitate to push the states” out of “fear of risking their relationships,” one report reads. Another notes that E.P.A. offices lack “a consistent national oversight strategy.”

Some of those memos, part of an effort known as the State Review Framework, were obtained from agency employees who asked for anonymity, and others through Freedom of Information Act requests.

Enforcement lapses were particularly bad under the administration of President George W. Bush, employees say. “For the last eight years, my hands have been tied,” said one E.P.A. official who requested anonymity for fear of retribution. “We were told to take our clean water and clean air cases, put them in a box, and lock it shut. Everyone knew polluters were getting away with murder. But these polluters are some of the biggest campaign contributors in town, so no one really cared if they were dumping poisons into streams.”

The E.P.A. administrators during the last eight years — Christine Todd Whitman, Michael O. Leavitt and Stephen L. Johnson — all declined to comment.

When President Obama chose Ms. Jackson to head the E.P.A., many environmentalists and agency employees were encouraged. During his campaign, Mr. Obama promised to “reinvigorate the drinking water standards that have been weakened under the Bush administration and update them to address new threats.” He pledged to regulate water pollution from livestock operations and push for amendments to the Clean Water Act.

But some worry those promises will not be kept. Water issues have taken a back seat to other environmental concerns, like carbon emissions.

In an interview, Ms. Jackson noted that many of the nation’s waters were healthier today than when the Clean Water Act was passed and said she intended to enforce the law more vigorously. After receiving detailed questions from The Times, she put many of the State Review Framework documents on the agency’s Web site, and ordered more disclosure of the agency’s handling of water issues, increased enforcement and revamped technology so that facilities’ environmental records are more accessible.

“Do critics have a good and valid point when they say improvements need to be made? Absolutely,” Ms. Jackson said. “But I think we need to be careful not to do that by scaring the bejesus out of people into thinking that, boy, are things horrible. What it requires is attention, and I’m going to give it that attention.”

In statements, E.P.A. officials noted that from 2006 to 2008, the agency conducted 11,000 Clean Water Act and 21,000 Safe Drinking Water Act inspections, and referred 146 cases to the Department of Justice. During the 2007 to 2008 period, officials wrote, 92 percent of the population served by community water systems received water that had no reported health-based violations.

The Times’s reporting, the statements added, “does not distinguish between significant violations and minor violations,” and “as a result, the conclusions may present an unduly alarming picture.” They wrote that “much of the country’s water quality problems are caused by discharges from nonpoint sources of pollution, such as agricultural runoff, which cannot be corrected solely through enforcement.”

Ultimately, lawmakers and environmental activists say, the best solution is for Congress to hold the E.P.A. and states accountable for their failures.

The Clean Water Act, they add, should be expanded to police other types of pollution — like farm and livestock runoff — that are largely unregulated. And they say Congress should give state agencies more resources, in the same way that federal dollars helped overhaul the nation’s sewage systems in the 1970s.

Some say changes will not occur without public outrage.

“When we started regulating water pollution in the 1970s, there was a huge public outcry because you could see raw sewage flowing into the rivers,” said William D. Ruckelshaus, who served as the first head of the Environmental Protection Agency under President Richard M. Nixon, and then again under President Ronald Reagan.

Fallout from nuclear tests leads to Hawaii health crisis

HONOLULU — Pius Henry fears his adopted government will kill him, that the U.S. won't live up to a health care obligation to people from Pacific islands where it tested nuclear bombs.

Henry, a diabetic from the Marshall Islands, has received free dialysis treatments three times a week for years, but the cash-strapped state of Hawaii has threatened to cut off him — and others — to save money.

Like thousands of legal migrants to Hawaii from independent Pacific nations, Henry believes the U.S. has a responsibility to provide health care to compensate for the radioactive fallout of 67 nuclear weapons tests from 1946 to 1958.

"I don't have any option. I'm asking the government to help us," Henry said. "They say we're like U.S. citizens, but then they don't treat us the same. It's really unfair."

A federal judge's ruling Sept. 1 temporarily prevented Hawaii from halting critical dialysis and chemotherapy treatments to hundreds of migrants from three nations: Micronesia, the Marshall Islands and Palau. His order lasts at least until October.

Those three countries are beneficiaries of the Compact of Free Association, a 1986 pact with the U.S. granting it the right to use defense sites in exchange for financial assistance and migration rights.

With doctors and medical facilities lacking in their own countries, many with life-threatening conditions have moved to Hawaii seeking better health care, education and quality of life.

The islanders have struggled adjusting to American culture and their new home. They fill public housing projects and a disproportionate share of homeless shelters, according to a 2007 study. Without college degrees or a command of the English language, many work in fast-food or hotel jobs, which still pay far better than they could earn in their home countries.

"We're the last immigrants," said Innocenta Sound-Kikku, a Micronesian whose father, Manuel Sound, suffers from diabetes. "We come here for the same thing everyone else came here for — the chance for the American dream. The U.S. has an obligation after what they've done to us."

The nuclear testing occurred in the Marshall Islands, carrying the explosive power of 7,200 Hiroshima bombs, said Dr. Neal Palafox, chairman of the Department of Family Medicine and Community Health at the University of Hawaii. The blasts contaminated thousands of miles across the Pacific Ocean.

The residual radioactivity led to high rates of leukemia and thyroid, lung, stomach, skin and brain cancers, Palafox said. Fallout exposure could result in about a 9 percent increase in cancer in the Marshall Islands, according to a 2004 National Cancer Institute estimate provided to a U.S. Senate committee.

"It's a monster increase in cancer rates no matter how you look at it," Palafox said.

He said that while the high rate of diabetes isn't directly connected to the nuclear tests, fast foods and processed meats introduced by the U.S. led to worsening diets in a culture that was dependent on fishing.

The migrants also widely believe the U.S. owes them for their various illnesses because of the destruction to their homelands and the displacement and agony they have suffered.

While living with diabetes and high blood pressure,Sound takes about 11 pills daily and said he feels wary of death. If he missed any of his 3½-hour, thrice-weekly dialysis treatments, his health would be in danger.

"One day you miss, and the poison begins to circulate in your bloodstream. I could die if I'm not careful," said Sound, who has lived in Hawaii for seven years after migrating from Micronesia. "With these budget cuts, I really thought I was going to go."

The state of Hawaii sought to save $15 million by cutting health services to more than 7,000 migrants, who are treated as legal residents lacking citizenship. Their ambiguous status, as well as their cost to taxpayers, led to the state's proposed health reductions.

Both the Hawaii government and the migrants argue that the U.S. government should take responsibility for their health treatments.

But federal Medicaid funding to the migrant islanders was slashed when welfare reform passed in 1996, resulting in Hawaii picking up the tab. U.S. Rep. Neil Abercrombie, D-Hawaii, said he is trying to reinstate Medicaid benefits for compact migrants as part of the pending health care legislation.

"The United States cannot wash its hands clear of this responsibility because the islands will still have that nuclear testing effect for the next 2,000 years," said William Swain of the Marshallese community organization Pa Emman Kabjere, which means "don't let go of a good hand."

In Swain's family, 15 siblings on his father's side died from cancer, with the men suffering from thyroid cancer and the women from urine and breast cancer, he said. His 12-year-old niece has been diagnosed with thyroid cancer, and his older brother died from thyroid cancer two months ago.

While the government lacks data showing how quickly people are moving from these island nations, there were about 12,215 migrants of the Compact of Free Association states living in Hawaii in 2008, according to the U.S. Census Bureau.

Many of the migrants said it's racially discriminatory for the U.S. government to grant lifesaving health coverage to poor Americans while denying it to them.

"It's wrong for people to be so prejudiced," said Tita Raed of Micronesians United. "Most of the people in Hawaii moved here. This is not their native island, but they're upset when other people move here."

KSU dubs mining move ‘sell-out’

Shillong, Aug. 25: The anti-mining lobby in Shillong has begun working overtime to oppose the state cabinet’s decision to allow groundwork for uranium mining in West Khasi Hills.

The powerful Khasi Students’ Union today termed the cabinet’s decision as a total sell-out of the interest of the people to the Uranium Corporation of India Limited (UCIL) and indicated drastic steps to prevent work.

KSU president Samuel Jyrwa said: “Our central executive committee will meet soon to chalk out our action plan to deal with the decision of the cabinet. Our stand is very clear. We are totally opposed to uranium mining and there is no change in our approach.”

He said the state cabinet has taken a hurried decision despite the fact that a majority had opposed uranium mining during the official public hearing held on June 12, 2007, in West Khasi Hills.

The state cabinet yesterday gave its nod to pre-development work to be undertaken by the UCIL at the uranium mining sites with a budget of Rs 209 crore. The cabinet also favoured leasing out around 422 acres to UCIL to start uranium mining.

The government hopes to get a royalty of Rs 20 crore a year once mining begins.

“We feel that these development activities are not for the sake of the people and once the schools and health centres are constructed, they will be taken over by the UCIL and will become their properties,” he said.

“We are not against development, but the aggressive development pattern risking the welfare of the people are not acceptable to us,” Jyrwa said.

The KSU leader said they are also concerned over the heath hazards of uranium mining.

“You cannot buy health with money,” Jyrwa said.

50 Years After America’s Worst Nuclear Meltdown

Human error helped worsen a nuclear meltdown just outside Los Angeles, and now human inertia has stymied the radioactive cleanup for half a century.

“We know there was a fuel meltdown,” said William Taylor, the current spokesman for the U.S. Department of Energy. “We don’t know how much [radiation] or if any was released.”

According to an analysis of a five-year study by a panel of independent scientists convened years after the incident, the SRE accident spit out up to 459 times the amount of radiation released during the 1979 meltdown at Three Mile Island.

Fifty years later, the contaminated site has yet to be cleaned up, although this month two federal agencies promised to plow ahead without the site’s current owner, Boeing. And in March, the Department of Energy provided $38.3 million in funds to complete the radiologic survey of “Area IV” as part of the American Recovery and Reinvestment Act. Unlike the then-remote hilltop it once was, now more than a half million people live within 10 miles of The Hill, and downtown Los Angeles is 30 miles away.

The Santa Susana Field Laboratory was built on 2,850 acres in the mid-1940s. A portion of the facility was dedicated to nuclear research, while other portions were marked to develop powerful rocket engines such as the Delta II. The federal Atomic Energy Commission and the private Atomics International chose the land high in the hills above the farthest end of the west San Fernando Valley precisely because the work could be dangerous and the population sparse………….

Meanwhile, the SRE was but one of 10 nuclear reactors at the site, plus a “hot lab” to cut apart and work on nuclear fuel for Santa Susana, Department of Energy and the Atomic Energy Commission facilities from around the country. The site also hosted a plutonium fabrication fuel facility which Dan Hirsch, president of the nonprofit anti-nuclear group the Committee to Bridge the Gap, called “perhaps the most dangerous facility they had on the property.”……………………..

The end of 20 years of silence

None of what John Pace described was ever revealed publicly. Atomics International prepared an unclassified report — it was titled “SRE Fuel Element Damage” — on the accident and delivered it to the Atomic Energy Commission in 1961………………….

…………………Once the widespread nature of contamination was known, (over 20 years later) the U.S. Environmental Protection Agency was brought in to aid in the cleanup. One focus of concern was the level of contamination in the actual power plant buildings…………………

In the early 1990s, local legislators established the Santa Susana Field Laboratory Advisory Panel,…
“They found that the workers had increased death rates from key cancers like lung cancer, cancers of the lymph and blood systems, than did workers at the same facility that had lower exposure to the radiation,” Hirsch said. “That then led our panel to study the offsite population. We needed to know the wind data. And Boeing (now the owner of the site) refused to release it. So we had to draw more general conclusions.”

Those conclusions were released in October 2006 and they were stunning. Based on the ratios of volative radionuclides found in the coolant, the panel estimated that the release of radiation in 1959 was hundreds of times the amount of radiation that was released at Three Mile Island — and that radiation was estimated to have caused between 300-1,800 cancer deaths.

Despite all this, the site remains toxic, radioactive and dangerous, and will continue to be so until the cleanup is completed. And it’s still a workplace for scientists and technicians:………………

The future of nuclear energy

As the Obama administration is developing a strategy for the nation’s energy needs, including a nuclear component, there are many environmentalists who see the struggle to clean up the SSFL as an object lesson.

“You know the old saying, ‘Those who cannot remember the lessons of the past are condemned to repeat them,” Hirsch said. “People today are not remembering what happened the last time we went deeply into nuclear power. We had meltdowns and horrible accidents that we are spending billions of dollars unsuccessfully trying to clean up.”

Proponents of a nuclear revival say it is part of the answer to reduce the nation’s carbon output. But Hirsch sees that path as a large step backwards. “It’s a tragedy because this could be the point where we really solve the global warming problem.”

Aug. 13, 2009 - In the latest installment of The Researcher's Perspective, the new podcast series by Environmental Health Perspectives (EHP), Dr. Josh Hamilton discusses the potential implications of his recent mouse study on arsenic exposure and immune response to influenza A/H1N1. Hamilton and his colleagues found that mice exposed to 100 parts per billion (ppb) arsenic in drinking water had a significantly compromised innate immune response to infection with a mouse-adapted subtype of H1N1 influenza. When this first line of immune defense was suppressed by arsenic, mice infected with H1N1 became severely ill. In comparison, flu symptoms in mice that were not exposed to arsenic were relatively mild, even though the animals were infected with the same H1N1 strain.

In the new podcast Hamilton explains, "With so many people potentially exposed to arsenic in drinking water, the implications for increased mortality from influenza viral infections and bacterial infections could be profound." Contamination of drinking water by natural geological sources of arsenic is the primary route of exposure to this element. Hundreds of millions of people worldwide, including up to 25 million Americans, drink well water containing levels of arsenic above the U.S. Environmental Protection Agency's limit of 10 ppb.

"I would urge anyone who's on a private well supply to have their water tested," Hamilton said. "People may not realize that only public water supplies are regulated by the state and federal government, and that private, unregulated wells are untested [on a routine basis] unless the homeowner chooses to do that."

The study by Hamilton and colleagues, available online at www.ehponline.org, will appear in the September 2009 issue of EHP.

What would uranium mining mean?

Uranium mining has never been done safely anywhere in the world. It cannot be done safely.

Logically, that should end this discussion, but it will not, because a few individuals, shielded from liability behind Virginia Uranium Inc. (VUI) - a US corporation, wholly owned by Canadian corporations - would reap huge profits from mining and milling uranium on 2,000+ acres in rural Pittsylvania County. And the Coles Hill mine would be merely the first mine in eastern Virginia, as our entire Piedmont is strewn with uranium deposits and VUI's corporate mandate is to explore and develop them. If, as it surely will, the legislature lifts the moratorium, Virginia's Piedmont would become a uranium mining corridor, just as Eastern Kentucky, Southern West Virginia and Southwest Virginia are coal mining corridors.

As planned, the Cole's Hill uranium mine would cover an area equal to 55 square city blocks, and would be 800 feet deep. Through the blasting, extracting and crushing of uranium-bearing rock, open-pit mines and their huge, onsite tailings (waste) piles release into the environment heavy metals (including arsenic, lead and mercury) and radioactive materials (including thorium-230, radium-22, radon-222 and its progeny - various radioactive isotopes of bismuth, polonium and lead).

The radioactive contaminants persist in the environment anywhere from hundreds of thousands of years to four billion years. They are bioaccumulative - taken up and retained by plants and animals - and they become part of the food chain forever. In animals (including Homo sapiens), the radioactive toxins cause lung, kidney and liver damage, cancers, leukemias and genetic mutations. In mammals, these contaminants are passed on to future generations in utero and via breast milk - they're the gift that keeps on giving.

Once released into the environment, the heavy metals and radioactive contaminants travel great distances. Leached into ground and surface water in Pittsylvania County, they would contaminate the Roanoke River Watershed to Virginia Beach, and to North Carolina's Albemarle Sound and the Atlantic Ocean. The wind-borne particulates would travel thousands of miles - every way the wind blows - in a few days, being dispersed along the way.

VUI's public relations team tells us that - this time - uranium mining would be done safely, because the mining and milling of uranium in Virginia would be done in accordance with a regulatory program developed by the Virginia Department of Mining, Minerals and Energy (DMME). What they don't tell us is that the purpose of our federal and state regulatory agencies is not to protect the environment and human health. Rather, their purpose is to permit corporations to destroy the landscape, contaminate the environment and degrade human health to whatever degree will ensure healthy corporate profit margins within a particular industry.

Monitoring and oversight by our regulatory agencies are inadequate to nonexistent. Since the federal Environmental Protection Agency (EPA) was created in 1970 and our state regulatory agencies emerged subsequently, all indications are that our water, soil and air are far more contaminated than before our federal and state regulatory systems existed. And human health continues to decline accordingly.

DMME presides over one of the most devastating mineral extraction processes in the world - mountaintop removal coal mining, which, in the Appalachian coal states, has razed hundreds of thousands of acres of once-forested mountains, buried thousands of miles of streams under the rubble and destroyed hundreds of coalfield communities. This is a legal activity permitted by the EPA and DMME. Can we rationally expect those agencies to protect us from the catastrophic effects of uranium mining in Virginia and beyond?

Those who would profit from uranium mining in Virginia say it would be an economic boon, with jobs and money pouring into the economically depressed Piedmont region. VUI says miners would receive $68,000 salaries - a princely sum in a county where the 2000 median household income was $35,000, the unemployment rate was 9.4% and 12% of the population lived below the poverty line.

What the corporate spin fails to mention, however, is that hard-rock mining requires skilled labor, and that experienced miners would be imported from other states to earn those $68,000 salaries and risk their health and lives. And that, wherever hard-rock mining occurs, surrounding communities become ghost towns and regional economies implode. The economic rewards are enjoyed only by the corporate owners and officers.

In Virginia's Piedmont, as in all regions cursed with hard-rock mining, the blasting, heavy truck traffic, environmental contamination and impacts to human health would cause real property values to evaporate. Local businesses would shut down, and the regional economy would collapse outward in every direction. The Bannister River - part of the Roanoke River Watershed - is less than a mile from the Coles Hill mine site, and there is absolutely no doubt that the Bannister and all waterways downstream would be contaminated.

The relevant question, then, is who decides what Virginia communities look like, how safe they are, what quality of life they enjoy? Who decides whether the Virginia Piedmont and beyond will be sacrificed for a uranium mining corporation's profits? Is it We, the People, or is it a handful of corporate executives, aided and abetted by the state legislature and regulatory agencies?

The Declaration of Independence states:

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. - That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed."

An ever-increasing number of citizens in Pittsylvania County and beyond, understanding the catastrophic effects uranium mining would wreak upon their communities and future generations, declare that they will not consent to this corporate assault, and that they will exercise their inherent local governing authority to enact binding local laws that will protect and preserve the health, safety and wellbeing of their communities and the ecosystem upon which all life depends.

Like Eastern North Carolina, the Town of Halifax is downstream from the planned uranium mine in Pittsylvania County. On February 7, 2008, in response to the concerns and demands of their citizens, the Halifax Town Council voted unanimously to enact the Halifax Corporate Mining, Bodily Trespass and Community Self-Government Ordinance, which was drafted, at the council's request, by the Community Environmental Legal Defense Fund, a Pennsylvania-based nonprofit law firm. The ordinance asserts the town's inherent local governing authority, bans mining within the town, and criminalizes chemical and radioactive bodily trespass.

Halifax Town Council member Jack Dunavant said of the decision, "This is an historic vote. We, the people, intend to protect our health and environment from corporate assault. It's time to invoke the Constitution and acknowledge the power of the people to protect our own destiny and end this era of corporate greed and pollution."

Citizens and elected officials of every community downstream and/or downwind from the planned Pittsylvania County mine site would do well to follow Halifax's lead and exert their inherent governing authority to protect themselves.

Selling our souls - and the very planet itself

The Mayans, the Hopi and numerous other predictive sources believe that we are living at the end of the age.

They foresee a period of worldwide destruction with the earth broken and altered in many places.

The new world order then will arise, though with a much less populated planet.

Already we see famine, disease pandemics such as swine flu with thousands expected to die, and the failure of our government and financial institutions.

Is this a prelude?

Whether or not the ancient people had a lock on human extinction, there is no way to say.

Certainly, we have lost much of our oneness with the sea of living things of which we are a part.

We have literally sold our own souls in order to exploit our environment for money.

This must change and it will, with or without humankind.

We can do as the aboriginal peoples have always done: living as a part of the natural order sensitive to the power and mystery of life or we can concrete, asphalt and kill our way through the planet as we now do.

Either we clean up our act, or our species cannot long endure.

Uranium nuclear debate like comparing apples to tomatoes

I enjoyed reading "Nuclear Power key to the worlds future."

I thank Jim Ford for his efforts; however Mr. Ford has done the same thing so many other supporters of uranium mining have done. They compare apples to tomatoes.

He is talking about how safe processed uranium is, stuff you keep in a cylinder 6" in diameter.

We are talking about "tons and tons of rock and dust" containing low levels of radiation.

Another example of mixing fruits and vegetables is the "energy from coal on a one to one basis compared to nuclear kills many times more people on a yearly basis."

Here he is comparing a nuclear energy plant to the people killed in coal mining.

There is no correlation between these.

Don't take the government's word on uranium mining

I have been reading a lot on various websites about the pros and cons of uranium mining in Pittsylvania County. I find a lot of conflicting information and misinformation.

Based on digesting what I read, I think that most of the populace of the county either is not involved or is waiting to be relieved of the responsibility of being involved by the "yea or nay" of the much purported "study" of whether it will be safe.

From what I am reading, this study is not even under way because it is not funded.

Not funded, I should add, in these times of government cutbacks, by any entity other than Virginia Uranium Inc., which has offered a generous amount to get it started.

Conflict of interest? Maybe, to any reputable institute who might be approached.

Or could it be that no reputable academic entity would sign their name to a safety stamp for an enterprise that God (or nature, if you prefer) could overturn in a moment with a hurricane, a flood, or some guy who pushed the wrong button?

Nah. That's too optimistic.

But the fact remains: Where is this study? Who is doing it?

What are we, the people, waiting on? I guess we know what the politicians are waiting on - $$$.

In the meantime, take the opportunity before it's too late. Do your own study.

Look at this, folks, and don't take the government's word for it.

DURING their early age, humans are most vulnerable to even small amounts of environmental toxins. What’s more troubling is that some of the effects of these exposures may only be seen or felt much later on in life.

This was the observation of Dr. Irma Makalinao, pharmacy and toxicology specialist and professor at the College of Medicine of the University of the Philippines, during a recent Philippine College of Physicians health forum.

One example Makalinao cited was children’s exposure to the heavy metal lead. Lead, in small amounts, affects a child’s nervous system and intellectual development. Recently, imported toys mostly made from China have been tested to contain lead.

“A child with otherwise normal physical and structural attributes could have his or her IQ (intelligence quotient) impaired because of lead exposure,” Makalinao said.

Other diseases that may be linked to environmental exposures of “fetal origin” include Parkinson’s disease, cancer, hypertension and heart disease.

Makalinao, a toxicologist and a pediatrician who advocates environmental health, said part of her job would be to investigate cases of exposures to lead, mercury and other toxic substances.

Certain toxic exposures, she noted, “could lead to an early manifestation of the gene for Parkinson’s disease since there’s a gene-environment interaction for a disease like Parkinson’s.”

Mad cow disease

BSE (bovine spongiform encephalopathy), more commonly known as mad cow disease, is a debilitating nervous system condition in cows that affects the animal’s behavior and movements. A cow infected with BSE would seem to act “mad.”

Dr. Richard Lacey, a prominent microbiologist and BSE researcher, has said there is an overwhelming scientific and medical case for avoiding the consumption of meat and meat products just to avoid BSE being transmitted to humans.

The connection between BSE and humans was uncovered in Great Britain in the 1990s when several youngsters died of a brain disorder, which was discovered to be a variation of a rare brain disorder called Creutzfeldt-Jakob Disease (CJD), which typically strikes elderly people.

Dr. Jaime Montoya, in an interview with Inquirer Science/Health, explained that CJD “is a progressive deterioration of mental status of patient who may have ingested infected brain from cattle and other livestock. BSE has been implicated in the use of ground beef and infected cow parts as part of cattle feed.”

However, Montoya added that no data were yet available for the incidence of CJD and BSE in the Philippines.

Disturbing occurrence

During the PCP forum, Makalinao explained that another disturbing occurrence happens whenever meat is grilled.

“When we burn meat, what is generated are polyaromatic hydrocarbons (polycyclic aromatic hydrocarbons).” These PAHs, she explained, are linked to the development of cancer in humans.

“From the perspective of pharmacogenetics, there is what we call the gene-environment interaction as well. If a person having a particular gene (that carries a certain susceptibility to a type of cancer) becomes exposed to a trigger, the risk for developing cancer is higher so that sometimes even if the exposure is not repeated several times, then the possibility of developing that type of cancer would actually be more likely than another person who does not carry the gene.”

Makalinao added that part of the studies being conducted by the UP Institute of Human Genetics is “to find cancer susceptibility genes particularly in relation to smoking and some other factors so that we can actually advise people more adequately about this issue on the development of cancer.”

Dr. Eva Maria Cutiongco-de la Paz, assistant director, Institute of Human Genetics, National Institute of Health, UP Manila, confirmed to Inquirer Health this week that the institute has projects on identifying one’s gene variation that increases risk for a particular disease as well as environmental risks (such as potential carcinogens).

She also stressed the importance of ethnic variations tests specific for Filipinos who needed to know their risks and how they can help themselves avoid these risks.

Uranium mining could present WA communities with a variety of health problems, from leukemia to congenital defects, according to a health expert at a recent forum.

Speaking at the Public Health Association of Australia’s “Uranium Mining: What are the health risks for WA?” seminar, Nobel Peace Prize nominee Dr Helen Caldicott said the public health effects on Western Australians could be disastrous if plans to begin uranium mining in the State go ahead.

Dr Caldicott said miners and nearby residents could be at risk should they be exposed to harmful materials.

“Often when people mine uranium, radon in the form of gas is inhaled into the terminal bronchi, which quickly converts by radioactive decay to lead (Pb212, Pb210) which induces lung cancer.

“All radiation is cumulative, every small amount of radiation you get adds to your susceptibility to cancer.”

Dr Caldicott also said the transportation of uranium could prove a serious health risk to regional communities.

“After processing the uranium is packed into drums and transported on road trains. There will be accidents. If one of those trucks jacknifes and turns, the drums would certainly break apart and the uranium could be released and the powder would be spread around Kalgoorlie.

“The region could then be contaminated for ever more.”

Dr Caldicott said uranium exists naturally in two forms, uranium-235 and uranium-238; present in 0.7 per cent in raw ore. It must be enriched to 3 per cent for use in reactors, greater than 50 per cent to produce bombs. She said a huge amount of ore would need to be mined to produce small amounts of uranium.

Uranium mining has been on the agenda in WA recently with several projects being considered by developers since the newly-elected state government lifted the ban on uranium mining in WA.

Various groups and businesses, such as Australian Nuclear Science and Technology Organisation (ANSTO) and Rio Tinto, have endorsed uranium mining as a clean, low cost alternative to carbon heavy fossils fuels, however Dr Caldicott said uranium mining would drastically increase WA’s carbon emissions.

“With uranium mining you have to dig up hundreds of thousand of tones of ore and rock to discover the uranium. It is then crushed which produces more CO2.

“This is a very energy consuming process, to enrich the uranium."

Dr Caldicott is internationally recognised for her work on nuclear issues, as well as being the co-founder of Physicians For Social Responsibility and President of the Nuclear Policy Research Institute in Washington DC.

THE mining of blue asbestos at Wittenoom Gorge in the 1950s was a hazardous operation and the long-term consequences of it are now apparent.

Uranium mining overseas also has an appalling record of injury and disease suffered by the miners.

The long-term consequences of uranium mining include cancer, genetic disease and premature ageing.

Blue asbestos and uranium mining are very different industries from most other types of mining because they pose significant additional health hazards for miners, plant workers and the general public.

We are faced with a serious ethical question of whether the risks of uranium mining can be justified.

If we do mine uranium in regional WA, who will be responsible for the compensation of the workers, their families and the public affected by it?

Uranium Contamination Haunts Navajo Country

“There were a lot of things people weren’t told about the plight of Navajos and uranium mining,” Stephen B. Etsitty said.

The Slowman home, the same one-level cinderblock structure his family had lived in for nearly a half-century, was contaminated with potentially dangerous levels of uranium from the days of the cold war, when hundreds of uranium mines dotted the vast tribal land known as the Navajo Nation. The scientist advised Mr. Slowman, his wife and their two sons to move out until their home could be rebuilt.

“I was angry,” Mr. Slowman said. “I guess it was here all this time, and we never knew.”

The legacy wrought from decades of uranium mining is long and painful here on the expansive reservation. Over the years, Navajo miners extracted some four million tons of uranium ore from the ground, much of it used by the United States government to make weapons.

Many miners died from radiation-related illnesses; some, unaware of harmful health effects, hauled contaminated rocks and tailings from local mines and mills to build homes for their families.

Now, those homes are being demolished and rebuilt under a new government program that seeks to identify what are very likely dozens of uranium-contaminated structures still standing on Navajo land and to temporarily relocate people living in them until the homes can be torn down and rebuilt.

Stephen B. Etsitty, executive director of the Navajo Nation Environmental Protection Agency, and other tribal officials have been grappling for years with the environmental fallout from uranium mining.

“There were a lot of things people weren’t told about the plight of Navajos and uranium mining,” Mr. Etsitty said. “These legacy issues are impacting generations. At some point people are saying, ‘It’s got to end.’ ”

After a Congressional hearing in 2007, a cross-section of federal agencies committed to addressing the environmental and health impacts of uranium mining on the reservation. As part of that commitment, the federal Environmental Protection Agency and the Navajo Nation began working together to assess uranium levels in 500 structures through a five-year plan set to end in 2012.

Using old lists of potentially contaminated structures, federal and Navajo scientists have fanned out to rural reaches of the 27,000 square mile reservation — which includes swaths of Arizona, New Mexico and Utah — to measure levels of radium, a decay product of uranium that can cause lung cancer. Of 113 structures assessed so far, 27 contained radiation levels that were above normal.

“In these situations, you have contamination in somebody’s yard or in their house,” said Harry Allen, the E.P.A.’s section chief for emergency response in San Francisco who is helping lead the government’s efforts. “To us, that is somewhat urgent.”

Many structures that showed high levels of radiation were vacant; some families had already moved out after hearing stories of contamination in their homes. But eight homes still had people living in them, and the E.P.A. and Navajo officials have worked to convince residents that it would be unsafe to stay.

“People had been told they were living in contaminated structures, but nobody ever did anything about it,” said Will Duncan, an environmental scientist who has been the E.P.A.’s main representative on the reservation. “They would tell us, ‘We don’t believe you are going to follow through.’ ”

But with a budget of nearly $8 million, the E.P.A. has demolished all 27 contaminated structures and has begun building ones to replace those that had been occupied. Typically, the agency pays a Navajo contracting company to construct a log cabin or a traditional hogan in the structure’s stead, depending on the wishes of the occupants. Mr. Allen said the cost, including temporarily relocating residents, ran approximately $260,000 per dwelling and took about eight months.

The agency also offers $50,000 to those who choose not to have an old home rebuilt.

Lillie Lane, a public information officer with the Navajo Nation E.P.A. who has acted as a liaison between the federal government and tribal members, said the program held practical and symbolic importance given the history of uranium mining here.

Ms. Lane described the difficulty of watching families, particularly elders, leaving homes they had lived in for years. She told of coming upon two old miners who died before their contaminated homes could be rebuilt. “In Navajo, a home is considered sacred,” she said. “But if the foundation or the rocks are not safe, we have to do this work.”

Some families, Ms. Lane said, complained that their children were suffering from health problems and had wondered if radiation were to blame.

The E.P.A. has started sifting through records and interviewing family members to figure out whether mining companies that once operated on the reservation are liable for any damages, Mr. Allen said.

On a recent summer day, Fred and Clara Slowman proudly surveyed their new home, a one-level log cabin that sits in the quiet shadows of Black Rock Point, miles away from the bustle of Farmington, N.M., where the family has been living in a hotel.

Mr. Slowman said he suspected that waste materials from a nearby abandoned mine seeped into his house. The family plans on having a traditional Navajo medicine man bless their dwelling before they move in.

“In our traditional way, a house is like your mom,” he said. “It’s where you eat, sleep, where you’re taken care of. And when you come back from the city, you come back to your mom. It makes you feel real good.”

I am writing this letter in regards to the two letters to the editor by Larry Roach of Gretna and L. Mark de Paulo Jr. of Chatham.

I feel, in my opinion, that mining uranium at Coles Hill would be very dangerous and bad for the health of everyone around here.

These two gentlemen are not thinking our health is more important than money.

I would rather for our children to have a safe place to live.

When they grow up if they move away to get better jobs, that's fine; at least they will have a safe place to call home.

In my opinion, if we allow this mining we are not going to have a community because people are going to be very sick.

We need to pray and depend on God to take care of our needs.

I know that he will. He has taken care of us this far and he will continue.

That is what's wrong with the world today.

God puts something in the ground for a reason and we come along and dig it up for a profit and then people begin to get sick and drop dead all around us and we wonder why.

I am part Cherokee Indian and the Indians call this mining robbing Mother Earth.

If we stand by and allow them to mine this stuff, that is just what we are doing-robbing God in my opinion.

It has been in the ground this long. How about let's leave it there.

Think about it.

Tritium found at Peach Bottom

Comment: Seems tritium is a big problem, however, the nuke bunch is always saying that nuke plants have never killed anyone! Seems strange people around nuke plants have a high rate of all forms of cancers! I usually do not include comments but the comments are good and telling of cancers in the local people!

Levels of tritium six times higher than federal standards were identified at Peach Bottom Atomic Power Station in Delta earlier this week.

Exelon Nuclear reported Friday that tritium had been discovered in a localized area on the nuclear plant's property by plant workers performing environmental monitoring.

The tritium, which at high levels has been linked to cancer, was identified Wednesday from a sample taken Monday.

The highest sample concentration showed tritium levels of approximately 123,000 picocuries per liter of water, a news release from Exelon said. A picocurie is one-trillionth of a curie, a measurement of radioactivity.

The U.S. Environmental Protection Agency's standards allow no more than 20,000 picocuries per liter in the environment.

"This is not a public or employee health and safety issue, but we are committed to being open about the status of our plant operations," Peach Bottom site vice president Bill Maguire said in the news release.

The amount of radiation someone would receive if they drank two liters of the water found with the highest level of tritium every day for a year would be equivalent to what someone would receive during six cross-country airplane trips, according to data provided by the plant.

Tritium is a normal byproduct of nuclear energy, created during the fission process. It also occurs naturally in the environment. It is most often found in water, and it disperses into the atmosphere.

Tritium is used commercially to make luminous dials and instruments and as a source of light for exit and safety signs. It also is used as a tracer for biochemical research and in groundwater transport measurements.

The elevated levels of tritium were found in an area adjacent to the Peach Bottom Unit 3 turbine building, which is centrally located on plant property and a significant distance from plant boundaries, according to the news release.

Although additional sample testing is being performed to verify that the tritium is contained to the area where it was found, Bernadette Lauer, an Exelon spokesperson, said no detectable levels of tritium have thus far been found off-site.

Plant engineering and environmental teams are working to locate the tritium source and make necessary repairs, Lauer said.

Exelon Nuclear officials notified state and federal authorities Thursday after the tritium sample was confirmed.

"Our environmental monitoring program works," Maguire said. "It alerted us to the presence of tritium early so that we can address the issue quickly."

Peach Bottom is not the only local nuclear power plant that has discovered elevated levels of tritium on its property.

In September 2006, Three Mile Island found groundwater containing tritium that had migrated into the Susquehanna River, where it was immediately diluted to nondetectable levels, according to published reports.

The reports said TMI's monitoring was prompted by the discovery of leaks of tritium at three nuclear plants in Illinois owned by Exelon Nuclear in 2005.

Lauer identified the plants as Braidwood in Braceville, about 60 miles southwest of Chicago; Byron Generating Station in Byron, about 90 miles west of Chicago; and Quad Cities Generating Station in Cordova, about 120 miles west of Chicago.

Just last month, Exelon's Dresden nuclear plant near Morris, Ill., about 60 miles southwest of Chicago, found tritium levels of 3.2 million picocuries per liter of water in a monitoring well, storm drains and a concrete vault near an outside water storage tank, she said.

Exelon's plant in Oyster Creek, N.J., also had elevated tritium levels of 16,600 picocuries per liter in a June 12 sample, according to a company statement.

Exelon owns 10 nuclear plants: three in Pennsylvania, one in New Jersey and six in Illinois.

notveryhowI've had three siblings die of cancer, and two more have breast cancer now. All of us grew up in Peach Bottom. I' ve known so many people here who died of cancer. I've always thought that plant could be the reason.

HUMAN HARM FROM LOW-LEVEL EXPOSURE.

Comment: Remember, uranium milling sometimes process "low level" radioactive wastes! Therefore, if the EPA says it is at safe levels, it may not be true! All forms of radiation are dangerous!

The federal government is proposing to allow large quantities of "low level" radioactive wastes to be declared non-radioactive ("below regulatory concern," or BRC, is their phrase for it; see RHWN #183).

These radioactive wastes would then be handled like ordinary household trash; they would be transported, landfilled, incinerated, reused (for example, radioactive tools) or recycled (for example, radioactive metals) along with everything else we discard each day.

Such a change would expose Americans randomly to more ionizing radiation than they are exposed to today.

Government and industry both argue that this is acceptable. Industry uses one justification, government uses another.

Many people in the nuclear industry argue that small increases in ionizing radiation aren't dangerous at all. They argue that there is a threshold dose of radiation, below which no effects occur, and above which people may be harmed (see RHWN #184).

They say the BRC program will not expose anyone to a dose of radiation greater than the threshold dose, and therefore the BRC program will cause no harm.

Government approaches the matter differently. The U.S. Environmental Protection Agency (EPA) argues that any amount of radiation causes some damage to a large population of exposed individuals; they subscribe to the "linear theory" of radiation damage (see RHWN #184).

They have set limits for radiation exposure based on the moral premise that it is acceptable to kill one citizen out of every 100,000 citizens by exposing them to radiation.

Since the BRC program will not cause exposures that would kill more than one in every 100,000 citizens (and the linear theory tells them that, in reality, the program will kill many fewer people than one in every 100,000), the government argues that the BRC program is acceptable because it will save billions of dollars for the nuclear power industry (which must soon dismantle its aging nuclear reactors and put them "away" somewhere) and for the government itself (which must eventually clean up millions of pounds of radioactive contamination lying around near weapons factories).

Unfortunately, there is now very substantial evidence, from studies of human beings exposed to radiation, that both industry and the government have misunderstood (intentionally or not) the dangers of low levels of ionizing radiation. (By "low levels" we mean within the range 0 to 5 rem [centi-Sievert].)

The most compelling evidence comes from studies of 91,231 people who survived the atomic bombings of Hiroshima and Nagasaki in Japan in 1945. Contrary to popular belief, most of these survivors received only very low exposures to ionizing radiation. Their health has been continuously monitored by international scientific organizations, so they represent the best available information on the effects of low levels of ionizing radiation on humans.

The bomb survivor data now shows without doubt that there is no safe dose of radiation and, furthermore, that the lowest doses have caused the greatest cancer increases per unit of radiation. (In other words, the shape of the dose-response curve is supra-linear; see RHWN #184.)

This means that both the industry assumption (threshold theory) and the EPA's assumption (linear theory) seriously underestimate the dangers from exposure to low levels of ionizing radiation.

Furthermore, the Japanese data reveal another important fact about low-level radiation: young humans (children and infants) are more sensitive to the effects of low levels of ionizing radiation than are older humans. We will discuss the Japanese data in detail at another time.

Here we will discuss more recent human data provided by accidents that released large amounts of ionizing radiation at Chernobyl (Soviet Union, 1986), Three-Mile Island (Pennsylvania, U.S.A., 1979), and Savannah River (Georgia, U.S.A., 1970).

These accidents are the subject of a shocking new book: Jay Gould and Ben Goldman, DEADLY DECEIT, cited in our last paragraph. Page numbers inside parentheses in our text refer to this book.

Like the Japanese bomb survivor data, these three accidents indicate that the lowest doses of ionizing radiation cause the greatest human damage per unit of radiation. This provides confirmation that the government's estimate of the hazards of low-level radiation is low; that is to say, today's allowable limits for human exposure to ionizing radiation will allow more deaths than our government officially admits. How many more is the question. Bomb survivor data indicate 30 times more, but even this may be low, according to Gould and Goldman.

The three accidental releases of large quantities of radiation also confirm what the bomb survivor data are showing: that infants and children are the most sensitive to damage from low levels of ionizing radiation. Consider these facts:

The Chernobyl nuclear power plant blew up on April 26, 1986; nine days later, radioactivity monitoring stations in Washington state (9,000 miles from Chernobyl) detected radioactivity in rainfall.

By May 16th, 50 EPA monitoring stations detected radioactive iodine-131 in cow's milk all across the U.S. Our government said "no problem."

Now government data, analyzed by Gould and Goldman, show that in May, 1986, there was a 5.3% increase in the U.S. death rate, compared to the previous year; the chances are less than one in a thousand that this increase occurred by chance. During June, 1986, the infant mortality rate in the U.S. was 12.3% higher than it had been in June, 1985, and in some parts of the country it was much higher; for example, in the south Atlantic states, the infant mortality rate in June, 1986, was 28% higher than it had been the previous year. Based on this, and on much additional evidence that we haven't space to review, Gould and Goldman suggest that current EPA limits on exposures to low level radiation may need to be tightened by as much as a factor of 1000 (pg. 21).

In November and again in December, 1970, two nuclear rod meltdowns occurred at the Savannah River nuclear weapons plant in Georgia.

The plant was operated for the government by DuPont, who never told the public anything about these accidents until Senator John Glenn grilled Dupont officials in public hearings in late 1988.

To this day, DuPont claims that no radiation escaped outside the plant, but official government measurements of radioactivity in rain throughout the southeastern U.S. reveal highly suspicious increases immediately after the accidents. In South Carolina in December, 1970, rain carried six times as much radioactivity as it had carried in December, 1969.

Radioactivity was also measurable in local fish; fish in the Savannah river contained radiation levels 100,000 times higher than fish sold in New York City in 1971.

A child who ate 1/4 pound of catfish from the Savannah River in 1971 would have received a radiation dose equivalent to 20 chest xrays. Infant mortality in South Carolina in January, 1971, was 24% higher than it had been a year earlier; in contrast, infant mortality declined that month over the entire U.S. and over the southeastern states taken as a whole. During the following summer (May through September) infant mortality in South Carolina was 15% higher than it had been the previous year. Again, we are omitting a wealth of detail.

March 28, 1979, a meltdown at the Three Mile Island (TMI) nuclear power plant spewed more than 10 million Curies of radioactivity into the environment, most of it into the air. Because the radiation dispersed quickly, most people received only low levels of exposure. Government and industry spokespeople have repeatedly assured the public than no one was harmed.

However, the government's own health data tell quite a different story. Comparing the period three months prior to the accident against the period four months after the accident, Pennsylvania's infant mortality rate increased 16% and the state of Maryland's increased 41%. All together, Gould and Goldman calculate that perhaps as many as 50,000 deaths occurred during 1980-1982 as a result of the TMI accident (pg. 63).

This is an important book. Any individual fact in the book may be disputed, but the cumulative weight of the evidence is persuasive. And though we generally do not give much credence to conspiracy theories, if you read this book from cover to cover, you will have difficulty believing that your government is telling the full truth about the effects of low-level radiation. We suggest that you act prudently to protect yourself and your family: do whatever it takes to keep BRC wastes out of your community.
